Terms of Use

1. Acceptance of terms

By creating an account, signing in, or otherwise accessing the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. We may modify these Terms at any time; material changes will be posted with a new "Last updated" date and, where appropriate, communicated by email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. If you use the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms. The Service is not intended for users in jurisdictions where its provision would be unlawful.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access. We are not liable for any loss arising from your failure to safeguard your account.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or extract the Service's source code, models, or training data.
• Probe, scan, or test the vulnerability of the Service or breach any security or authentication measures.
• Submit content that is defamatory, harassing, abusive, obscene, or that infringes any third party's rights.
• Impersonate any person or misrepresent your affiliation with any entity.
• Use automated systems (bots, scrapers, crawlers) to access the Service without our prior written consent.
• Use the Service to develop a competing product or service.

5. Intellectual property

The Service, including all software, designs, text, graphics, the Zodiya brand mark, and any other materials, is owned by Zodiya or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

You retain ownership of the birth-profile data and any content you submit. By submitting content, you grant us a worldwide, royalty-free license to host, store, process, and display it as needed to operate the Service.

6. AI-generated content disclaimer

The Service uses artificial intelligence to interpret structured astrological data and generate text-based responses. AI output may contain errors, omissions, or unexpected results. Astrological readings are for entertainment and informational purposes only. They are not a substitute for advice from a qualified professional in matters of medicine, mental health, law, finance, or any other regulated field. Decisions based on the Service's output are made at your sole discretion and risk.

7. Subscriptions and payment

Paid plans (Pro, Premium) are billed in advance on a recurring basis until cancelled. Prices are listed on the pricing page and may change with at least 30 days' notice for existing subscribers. Refunds are issued at our discretion in accordance with applicable consumer-protection law.

You may cancel at any time from your account settings; cancellations take effect at the end of the current billing period. Free-tier usage limits (questions, profiles) are subject to fair-use enforcement.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice — including for breach of these Terms, suspected fraud, or extended inactivity. You may terminate your account at any time by deleting it from within the Service. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) will survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any output will be accurate, reliable, or suitable for any purpose.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZODIYA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total aggregate liability for any claim arising under these Terms will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Zodiya and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your use or misuse of the Service, (b) your breach of these Terms, or (c) your violation of any third-party right or applicable law.

12. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the courts of Bengaluru, Karnataka, India, and you consent to that jurisdiction. Nothing in this section limits your statutory consumer rights in your country of residence.
